To join Jassim Alwazzan Sons General Trading Company W.L.L online sales, delivery and all related services on the internet, hereinafter referred to as the "ATSAWAG" platform, the end user is requested to fill the registration form, agree and undertake to comply with ATSAWAG User Agreement terms. Upon filling and approving such form or receiving any services using the platform, you agree to the terms and conditions.
These terms and conditions apply to ATSAWAG platform which consists of all its applications on iPhone, iPad, Android systems or any other operating system and any mobile connected to the internet, browsers, any device not mentioned in this clause or any other device to be invented in the future which may be used and able to access ATSAWAG.
ATSAWAG platform and all information, scripting, photos, text, video, graphics, music, sounds, images and other materials and services found on ATSAWAG, is owned by Jassim Alwazzan Sons General Trading Company W.L.L and intended for the lawful use of any customer wants to use any of our services.
1.1 ATSAWAG is committed to protect the privacy of the members of our platform on the internet. In this policy, we will explain how your personal information is processed.
2. Personal Data Collection:
2.1 We may collect and save the following types of information:
a. All information about number of visits from your account and other information including but not limited to IP address, geographical location, type and version of the operating system and browser, visit period, pages and paths of navigation in the platform.
b. Any information you provide upon registration on our platform on the internet, including the e-mail address.
c. Any information you provided upon completion of creating your account on our platform including the name, gender, date of birth, hobbies, educational status and work details
d. Any information you provide to subscribe in email notifications and/ or newsletters, including name and e-mail address.
e. Any information you provide upon using our services on ATSAWAG.
f. Any information related to your purchases including name, address, GEO location/s, telephone number and e-mail address.
g. Any information given in any communication between you and any of ATSAWAG applications (including the call content and the associated metadata thereof).

i. Any details other than the personal information collected.
j. ATSAWAG will not save or use any of the data of the credit cards or ATM cards of the customer.
2.2 Before you disclose any third party personal information to us, you should obtain their approval to such disclosure and to process such information in accordance with our policy.
3. Use of Personal Information
3.1 The personal information provided to us through ATSAWAG platform will be used for the purposes prescribed in this policy or on the relevant platform pages.
3.2 We may use your personal information to:
a. Manage our platform and the business, services and transactions of the platform;
b. Personalize our online platform and your account;
c. Enable you to use the services made available on our platform;
d. Send the items purchased through our platform;
e. Provide the services requested through our platform;
f. Send data, invoices and payment reminder letters (if exists) to you and collect payments from you;
g. Send commercial non-marketing messages;
h. Send e-mails and notices;
i. Send our newsletter via email. (if you do not want to receive such messages, you can ask us to cancel this function at any time);
j. Send messages or emails or similar technologies related to our business or sister companies which we think will be useful for you. (if you do not want us to send such messages, you may inform us to cancel such function at any time);
k. Provide third parties with statistical information about our users, (any third party will not be able to identify any user by such information);
l. Deal with inquiries and complaints provided from or related to our platform;
m. Keep our platform safe and prevent fraud;
n. Verify compliance with terms and conditions that regulate the use of our platform, (including monitoring private messages sent through our message service on the platform); and
o. Any other uses.
3.3 If you provide personal information to be posted on our platform, we will post and use such information in accordance with the authorization you give us by approving this policy.
3.4 We will not provide any third party with your personal information without an express consent from you for any purpose other than direct marketing.
4. Disclosure of Personal Information
4.1 We may disclose your personal information to any of the employees, officers, insurers, technical consultants, agents, suppliers or subcontractors to the extent required for the purposes set forth in this policy.
4.2 We may disclose your personal information:
a. To the extent we are required to do under the law;
b. In respect of any present or expected legal procedures from or on the platform; and
c. For executing, practicing or defending our legal rights (including provision of information to others for the purposes of preventing fraud and reducing risks).
4.3 Except as stipulated in this policy, we will not provide your personal information to any third party for any purposes other than marketing and to the best of your interest.

5.1 The information we or any of our sister companies collect and process may be stored and transferred to any of the countries where we work or deal with in order to make use of it according to this policy.

6.1 This policy sets the mechanism of saving data and procedures, which were designed to help ensuring our implementation of our legal obligations in respect of reserving the right and deleting personal information.

6.3 Notwithstanding of other terms set out in this policy, we may save and keep documents (including e-document) which contain the personal data:

7. Personal Information Security
7.1 We will take technical and organizational precautions of prevention of losing, abusing or changing your personal information.
7.2 We guarantee that all personal information provided by you will be stored on protected servers (With security parameters such as firewalls, complex passwords, antiviruses and secure connections).
7.3 All financial e-transactions or e-payment cards data used in ATSAWAG platform is routed securely to a third-party payment gateway that is protected through encryption technology.
7.4 You hereby acknowledge that transferring data through the internet is not mainly safe, and we cannot warrant the safety and security of the data sent via the internet. Therefore, kindly avoid sending any sensitive data of financial nature to us via the internet.
7.5 You are responsible for maintaining confidentiality of the password you use for accessing our platform, and we will not ask you by email or by phone call or by SMS to provide your password, you will be requested to write the password only when you login to ATSAWAG platform.
7.6 You are responsible for ensuring that you are using your ATSAWAG username or password in only genuine applications or portals of ATSAWAG platform.
8.2 You are responsible for regularly reviewing ATSAWAG Terms and Conditions page to obtain timely notice of such amendments.
9. Your rights
In case the customer cancels the account, it will only be allowed:
9.1 We may withhold personal information that you request to the extent permitted by law.
9.2 You may instruct us to process your personal information for purposes of marketing.
9.3 Under this policy, you give us your prior and express consent to use your information for marketing purposes.
10. Platforms of Third Parties
Our online platform may contain hyperlinks and details of third parties' platforms.
10.1 We do not control, and we are not responsible for, the privacy policies, contents and practices of third parties.
11. Completion of Information
11.1 You are requested to update or correct your data in your account/profile whenever your personal information has been changed or modified.

13. Our objective:
The objective of our services is to provide the customer with a simple and convenient delivery service. ATSAWAG products normally traded or manufactured by the group companies. The order is executed and delivered to you wherever you are within Kuwait and if done through the ATSAWAG platform.
We designed ATSAWAG platform to be user friendly and to meet your needs within the shortest time and the least efforts, along with providing the ability to deliver orders through ATSAWAG platform. We will do our best to ensure that the products you requested are delivered to you in a timely manner.
14. How the Order is Placed and Implemented
Upon submitting the order, you should review the information entered carefully by selecting the order from the products list that is made available to you, because once you place the order, you cannot correct any mistakes. Therefore, when we receive your order, ATSAWAG platform will begin to execute the order and you will be notified through a message that your order has been successfully received and is being processed. Thus, you as a customer will be fully responsible for all information recorded in the order details with respect to the address or content of the order. In the case of unauthorized method of payment or if the payment was not made for any reason pertaining to the transaction, a message will appear stating that the payment was not completed and showing the part of payment process that is unaccepted, so that you can correct it.
Customers should pay the service charges when they pay online if the payment method is by k-net or credit card and upon the delivery of the products if the payment is cash on delivery; otherwise, the delivery team will withhold the delivery.
15. Registration to the ATSAWAG Platform
Any customer who wishes to register on ATSAWAG platform shall create a personal account on the platform and shall by themselves create a username or define their phone-number as username and create password without intervention from the platform management. If the customer had a previous account on the platform with the same username, the customer is notified of non-acceptance of the name due to presence of a previous account with the same name. Moreover, the platform is not responsible for the username in case of impersonation or usage of nick name by the customer.
ATSAWAG platform clarifies that the password specified by a customer will not be disclosed and it will be limited to the customer alone. Customer can change it at any time and is responsible for protecting the password thereof and not to disclose it. ATSAWAG is not responsible for the accuracy of the data entered by the customer, since the customer is solely responsible for the integrity of their data and they should notify the platform promptly if they find any change in their personal data as well as the customer can update their data on the platform.
The platform also is not responsible for the use of the account by persons other than the customer. One of the customer responsibilities is to protect his account details (username and password) and not to post or share it with any other party, since the customer is solely responsible for all orders made through his account. In case of suspecting that the account is hacked or used by others, the customer should notify the platform administration immediately to take the required actions.
ATSAWAG asserts the confidentiality of the user information and ensures not to share such information with any third parties, except for the purpose of promoting the services.
16. Responsibility of the Customer:
Upon using the services of ATSAWAG platform, the customer accepts and declares that:
First: The customer guarantees and declares that the information mentioned in the registration form is correct, and that the customer is solely responsible for all the information given in the registration form.
Second: The customer declares that he is solely responsible for all the feedback, ratings, opinions, and personal information he posts on the platform during use of the platform and related electronic applications.
Third: The customer declares his awareness that he holds the civil and penal responsibility for using the platform in sending any posts containing threats, immorality, racism, anti- religions or creeds, violation of the rules and public morals, good conduct, laws or any violation to the laws of the State of Kuwait and international conventions. ATSAWAG shall cooperate with any law enforcement entities or the court decisions requesting the revealing of the identity or location of any person who publishes any material in violation to the above-mentioned paragraphs.
Fourth: You as a customer undertake not to mistreat any of the customer service employees affiliated to ATSAWAG platform, and not to act in any manner to affect the use of the services by the other employees.
Fifth: You affirm that you are more than 18 years of age, agree to comply with all local laws regarding online conduct and acceptable content; and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms and Conditions of Use, and to abide by and comply with these Terms and Conditions of Use.
Sixth: The customer declares that the credit cards or prepayment cards used in any payment to ATSAWAG belong to the customer himself. If the card is owned by some other person, the customer must use it legally with the approval of the card owner. The card owner may not raise any claims against the platform if their card is used illegally by any customer.
Seventh: The customer declares that the products purchased from the ATSAWAG platform is only for personal or immediate family use and cannot be resold.
17. Order Cancellation
A customer may totally cancel the order within 5 minutes after placing the order by choosing 'Cancel Order' option from the orders history page. After 5 minutes of placing the order, any order cancelation request will not be accepted and the customer will be the only responsible for any financial loss that may result due to the late order cancelation request.
ATSAWAG platform reserves the right to cancel any order before or after acceptance of the order in case of force majeure event that might lead to the cancellation. The delivery charges will apply only if the delivery is complete. We will try our best to inform the member as soon as possible of any cancellation and its reasons without any liability on ATSAWAG.
18. Agreement Termination
You agree that ATSAWAG, in its sole discretion and without prior notice, may terminate or restrict your use or access to this website for any reason, including, without limitation, if ATSAWAG believes you have violated or acted inconsistently with the letter or spirit of these Terms and Conditions of Use.
19. Order Delivery
The operating business hours for the delivery, will be from 10.00 AM to 8.00 PM during regular working days.
The delivery schedule shall be within 24 and 48 hours from the time of order confirmation.
The staff of ATSAWAG delivery service will deliver the order. If you or the person indicated in the order is not present in the address defined in the order, the products ordered will not be delivered to any other location. In this case, the customer has to accept all the legal and financial responsibilities arising out of ordering a product to a new address.
ATSAWAG affirms its interest to deliver the order after collecting it from the relevant ATSAWAG warehouse/store/order processing centre/ showroom, taking in consideration certain obstacles, which are not attributable to the platform such as traffic, especially during rush hours, and bad weather, which might prevent us sometimes to deliver. However, ATSAWAG promises its customers that we will do our best to ensure that your order is delivered to you in a timely manner.
20. Partial Delivery / Return of Order
If ATSAWAG warehouse/store/order processing centre/showroom commits a mistake in the order, the order will be returned to the relevant ATSAWAG warehouse/store/order processing centre/showroom to correct it, then the relevant ATSAWAG warehouse/store/order processing centre/ showroom will bear the fees of the new delivery. If an order is made and the delivery is not the same or the delivery is with missing Item, then the buyer has the option to either request for a total or partial refund or delivery of the ordered product. In case of the latter, you as a customer will not be charged for the order until the right delivery is made.
In case of an order delivered as per the order requirements and the customer wishes to return all or part of the goods within the number of days as per Kuwait law, the customer should deliver the goods to ATSAWAG store located at ( location ) on physical investigation of the goods by the store manager, ATSAWAG has the right to either accept or decline the return of the goods. Refund of an accepted return shall be settled within 7 business days.
21. Price and Payment
If your order is accepted, this is deemed to be an agreement between you as a customer and ATSAWAG. At such time ATSAWAG assumes responsibility for such order. ATSAWAG platform gives you the option to pay by any of the following methods:
- Cash payment to the ATSAWAG representative delivering the order.
- Online payment using credit cards, K-net cards
Important note regarding Prepaid Cards/Credit Cards:
You, as the customer will be charged for the delivery or any other fees for each order. In all cases, the fees of delivery or any other fees will be indicated clearly in the summary of the order.
Credit cards or prepaid cards used for payment in ATSAWAG e-payment gateway must be under the name of the customer himself. If the card owner is another person, then you as a customer has to use it legally with the approval of the card owner. Any service charges levied by the credit card issuer will be borne by the card owner.
You will be fully responsible for the execution and placement of the order using the payment service by the prepaid/credit cards after careful reading of all the terms and conditions.

22. Refund Policy
ATSAWAG deals seriously with the satisfaction of the customers. If there is any problem with any order, please contact us through one of the ways mentioned in clause 27, we will help you and try to solve the problem. If billed by the ATSAWAG platform, you will be entitled to refund of all or part of the amount according to the following conditions: If you did not receive the order or received an incorrect order, a full refund may be made. If a part of your order is missing, we will partially refund the amount. In all cases, we will refund within three to five working days from the date of request for refund. However, ATSAWAG reserves a right not to refund for the delivered products if there has been a change in the physical condition thereof.
The refund of the amount to your account via the payment gateway may take 7 working days. If crediting the amount paid to your account is delayed, You must follow-up with the bank directly.
23- Exceptions and Limitations of Responsibility:
1. Under these terms and conditions, the following actions may not be taken whether they are set forth in another contract or otherwise:
a. Limitation or exclusion of any responsibility for death or personal injury resulting from negligence;
b. Limitation or exclusion of any responsibility for fraud or falsification;
c. Limitation or exclusion from any liabilities in any way not permitted by the applicable law;
d. Exclusion of any liabilities which cannot be excluded as per the applicable law;
- Limitations and exclusions from responsibility set forth in this clause or in other contracts under these terms and conditions: a. Are subject to clause (1) of the Limitations and Exceptions from responsibility; and
b. Govern all obligations resulting from this contract or platform or relating thereto, including the obligations resulting from the contract, liability in tort and violation of a legal duty.
To the extent that the information and services are available to us on our online platform free of charge and we will not be responsible for any loss or damage whatsoever.
We will not incur any losses resulting from any event (s) beyond our reasonable control.
We will not incur anything relating to any commercial losses, including but not limited to loss of profits, income, revenues, use, production, expected economies, business, contracts, commercial opportunities or goodwill.
We will not incur anything relating to any loss or damage to any data, database or programs.
We will not incur anything relating to any special and indirect loss or damage or the resulting effects.
You acknowledge, accept and agree that we have an interest in limiting the personal responsibility of our employees and workers, and for observing such interest, you acknowledge that we are a limited liability entity and that you agree not to file any claim, against employees in their personal capacity with respect to any losses resulting in connection with this platform or these terms and conditions, which will not, of course, limit or exclude the responsibility of the entity itself for employees’ actions and omissions).
24. Breach of these Terms and Conditions:
Without prejudice to any of our other rights under these terms and conditions, if you breached these terms and conditions in any way, or if it was reasonable that we suspect that you have breached these terms and conditions in any way, we may:
Send one or more official warning notices;
Suspend your access to ATSAWAG temporarily;
Prevent you from having access to ATSAWAG permanently;
Deny access from devices which use your IP to ATSAWAG;
Arrange with any or all of internet service providers to prohibit your access to ATSAWAG;
Suspend or delete your account on our platform. And Initiate legal procedures against you, whether in terms of breaching the contract or otherwise.
In case of suspension, prohibition or preventing access of your account into ATSAWAG or part thereof, you should not take any step to circumvent this suspension, prohibition or prevention (including but not limited to creating and/ or using a different account).
25. Law and Jurisdiction:
- This contract shall be governed and construed by Kuwaiti Laws;
- Any disputes arising from this contract under these terms and conditions shall be subject to the jurisdiction of Kuwaiti Courts.
If any of these terms and conditions is decided, by any court or other competent authority, to be illegal and/or unenforceable, the remaining clauses shall remain valid.
If the contract is decided to be illegal and/or unenforceable under these terms and conditions, and that it shall be legal and enforceable if part thereof is deleted, the part to be deleted shall be cancelled and the remaining shall remain valid.
26. Links from and to the Platform:
Links from and to ATSAWAG platform will be available 24 hours
We reserve the right to suspend or change any or all of our online services and stop advertising our platform on any mean of media, at any time pursuant to our sole discretion, without prior notice or explanation, and we shall otherwise retain our express right in these terms and conditions. You shall not be entitled to any indemnity for suspension or change of any services on our platform or for non-advertising the platform.
We remove all objective assertions and warranties from these terms and conditions, our online platform and the use of our platform to the maximum extent permitted by the applicable law, which are governed by clause 11.1 of these terms and conditions.
As an additional service, the platform may provide links to other platforms; some of which may belong to ATSAWAG while others may not. ATSAWAG is not responsible for any content of any page on the platform which were created and maintained by entities independent from ATSAWAG . Visiting any pages of third parties will be under your responsibility, and ATSAWAG platform will have no control on the said pages of other platforms and cannot warrant the accuracy, completeness or timing of the information included in such pages. Your use of this information is voluntary and your reliance on such information should only rely on independent review to the said content. References to commercial products or services on any of the said pages do not form or mean an approval by ATSAWAG.
